By accessing or using MyPhases ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
Description of Service
MyPhases is a Progressive Web Application (PWA) designed to help users track their menstrual cycles, symptoms, moods, and related health information. The App provides:
- Period and cycle logging
- Cycle predictions and fertility window estimates
- Symptom and mood tracking
- Data visualization and insights
- Optional reminders and notifications
- Offline functionality with cloud sync
Important Health Disclaimer
MyPhases is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.
The predictions, estimates, and insights provided by MyPhases are based on statistical averages and your logged data. They are estimates only and should not be relied upon for:
- Contraception or pregnancy prevention
- Pregnancy planning as the sole method
- Medical diagnosis or treatment decisions
Cycle predictions can be affected by stress, illness, medications, travel, and many other factors. Always consult a qualified healthcare provider for medical advice, diagnosis, or treatment.
User Accounts
Account Creation
To use certain features of MyPhases, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your password
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
Account Termination
You may delete your account at any time through the app settings. We reserve the right to suspend or terminate accounts that violate these Terms.
Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the App's functionality
- Reverse engineer or attempt to extract the source code
- Use automated systems to access the App without permission
- Impersonate another person or misrepresent your identity
- Share your account credentials with others
User Content and Data
Your Data
You retain ownership of all data you enter into MyPhases. By using the App, you grant us a limited license to store, process, and display your data solely to provide the service to you.
Data Accuracy
You are responsible for the accuracy of the data you enter. The quality of predictions and insights depends on consistent, accurate logging.
Partner Sharing
If you choose to share your data with a partner or other trusted person, you are responsible for managing that access. You can revoke shared access at any time.
Intellectual Property
The MyPhases App, including its design, features, content, and underlying code, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
Third-Party Services
MyPhases may integrate with third-party services (such as health platforms or wearables). Your use of these integrations is subject to the third party's terms and privacy policies. We are not responsible for third-party services.
Service Availability
We strive to keep MyPhases available at all times, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to:
- Scheduled maintenance
- Technical issues or outages
- Circumstances beyond our control
As a PWA with offline functionality, you can continue to use basic features and log data even when offline. Data will sync when connectivity is restored.
Limitation of Liability
To the maximum extent permitted by law:
- MyPhases is provided "as is" and "as available" without warranties of any kind
- We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
- Our total liability shall not exceed the amount you paid us (if any) in the 12 months preceding the claim
Indemnification
You agree to indemnify and hold harmless MyPhases and its affiliates from any claims, damages, or expenses arising from your violation of these Terms or misuse of the App.
Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of MyPhases after changes take effect constitutes acceptance of the modified Terms.
Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
